Introduction

I believe it's important that your website works perfectly and that our collaboration runs smoothly. With these terms and conditions, we know exactly what we can expect from each other. I've written them as clearly and simply as possible.

Who is who?

When you read 'you', 'your' or 'yours' in these terms, I mean you as the client.

When you read 'I', 'me' or 'my', I mean Deshna Kerrie van Aarssen, working under the name Your Website Made Easy, located at Nissaråsvägen 19, 438 98 Hindås in Sweden and registered with the Swedish Tax Agency under number SE711105186301.

When do these terms apply?

These terms and conditions apply to:

- all web design projects I do for you
- maintenance subscriptions for your website
- all quotes I provide
- follow-up assignments

As soon as you accept my quote or engage my services, these terms automatically apply.

Should any part of these terms become invalid for any reason, the rest remains in force. We'll then work together to find a suitable solution that aligns with the intention of these terms.

Collaboration with others

Sometimes I work with other professionals to make your project a success. I carefully select these partners. When they carry out parts of the work, these terms also apply to their activities.

When do we have a deal?

We have an agreement as soon as you:

- sign and return the quote
- confirm by email that you agree
- transfer the deposit
- actively participate by sending requested information, for example

In short: as soon as it's clear that you want to work with me, we can begin!

What's included in the price and when is there additional work?

My quote states exactly what I'll do for you and what it costs. For web design projects, I give the most accurate estimate possible. The final price may be slightly higher or lower, depending on the exact work required.

Unless stated otherwise, prices are:

- exclusive of any travel costs
- exclusive of VAT (moms)

When invoicing outside Sweden and within the EU, VAT is reverse charged when you have a valid VAT number and pay VAT.

Want something different or extras during the project? No problem! We'll discuss the new price and schedule. After your approval, I'll get started.

Maintenance subscriptions

For website maintenance and hosting, I work with fixed packages. For each package, you can see exactly:

- which services are included
- what it costs monthly

Need more than what's in your package? Then I charge my hourly rate for the extra work. It's always possible to upgrade or downgrade your subscription.

Price changes

I may need to adjust my prices, for example due to inflation or when I expand my services. You'll receive 3 months' notice. Don't agree? Then you can cancel.

What can you expect from me?

I'm fully committed to making your website a success. I work accurately and professionally, but cannot guarantee specific results. These also depend on factors beyond my control, such as:

- the quality of content provided
- technical developments in WordPress
- the functioning of third-party plugins

How your website works

Your website is built to work perfectly on:

- desktop computers
- tablets (iPad, Android tablets)
- smartphones (iPhone, Android)

I also test your site in all common browsers (Chrome, Firefox, Safari, Edge) in the current version. Small differences between browsers may occur. I only adjust these if they truly impact functionality.

Does your website also need to work in old browsers? That's possible, but requires extra time. I'll include this in the quote.

Scheduling

The schedule we agree on is an estimate. To meet it, I need your cooperation - for example, for providing content or feedback. If the schedule threatens to overrun, I'll discuss a new timeline with you immediately.

When we experience delays because you don't provide content, feedback, or other information on time, I may charge you additional project hours. Stopping and restarting a project always costs extra time and energy.

Privacy legislation

I'll sort out the basic privacy settings for your website. You're responsible for specific legal advice about privacy legislation and the content of your privacy policy or terms and conditions. I can refer you to a specialist.

Does your website always work flawlessly?

With a maintenance subscription including technical maintenance, I monitor your website and perform updates to WordPress, themes, and plugins.

Sometimes plugins can conflict with each other or security vulnerabilities may emerge. When this happens, I'll resolve it as quickly as possible. However, I'm not responsible for problems caused by WordPress, themes, plugins, and other software on your website.

Technical support: how to request it?

For support, I prefer to receive your questions via the troubleshooting form or by email (not via WhatsApp or social media). This way I can look at your question calmly and answer it properly. Please clearly state:

- what your question is
- which website or page it concerns
- how urgent it is

I help you during office hours: Monday to Friday from 9:00 to 17:00.

Reporting issues

You can report issues via the troubleshooting form on my website or by email. Outside office hours, I’ll handle urgent matters as quickly as possible, but I may not respond until the next working day.

If your site is completely offline or you can't reach me, you can contact your hosting provider directly.

What I expect from you

For a smooth project, I need your cooperation. When I ask for information, I'd like to receive it as quickly as possible. This helps meet the schedule.

Texts, photos, and other materials

Everything you provide (texts, images, logos) must be copyright-free or you must own the rights. Not sure? Check it or buy a licence.

You may not place content on your website that:

- infringes on others' intellectual property
- violates others' privacy
- is illegal or contains spam

If you do this anyway, I may take your website temporarily or permanently offline. I'll always warn you first, unless immediate action is necessary.

Confidentiality

I treat all information I receive from you confidentially. This doesn't apply if:

- you give permission to share it
- I'm legally obliged to share it
- the information is already public

How I handle personal data can be found in my privacy policy.

Cancellation: how does it work?

Projects:

You can always stop a project. You'll then pay for:

- the hours I've already worked
- work I've already outsourced to third parties
- software I've purchased specifically for your project

Maintenance and other subscriptions:

These have a minimum term of 3 months. After that, you can cancel, with your subscription continuing until the end of the current period. This can be the end of a quarter, half-year, or year, depending on the term you've chosen.

Project finished: what now?

When your website is finished and launched or your project is completed, I'd like to hear within 2 weeks:

- of je tevreden bent
- of er nog dingen aangepast moeten worden

Don't hear anything? Then I assume everything is as desired.

Are adjustments needed that fall within the assignment? Then I'll handle those immediately. For additional requests, I'll make a new quote.

Payment

You'll receive two invoices:

1. At project start: 50% of the project amount + any software costs
2. Upon delivery: the remaining 50%

Payment term is 15 days. For late payment, I may:

- charge statutory interest and collection costs
- terminate the agreement
- temporarily take your website offline

Naturally, I'll send a reminder first!

If we disagree

I prefer to prevent problems through good communication. Not satisfied with something? Let me know immediately, and we'll find a solution together.

Really can't resolve it? Then we can submit the dispute to the court in Sweden, under Swedish law.

Liability

Want to hold me liable? Send a clear email stating:

- what went wrong
- what damage you've suffered
- what you expect from me

My liability is limited to a maximum of the invoice amount of the assignment. For maintenance contracts: maximum the amount you've paid in one year.

I'm not liable for:
- indirect damage such as lost profits
- problems related to your web hosting
- problems due to future updates of WordPress, themes, or plugins
- damage due to force majeure

Changes to these terms

Sometimes I need to adjust these terms. You'll receive one month's notice. Don't agree? Then you can terminate the agreement.
